Whenever any offense is committed under the legal metrology act by way of providing improper declarations and by not complying with the rules and regulations of the act, the legal metrology officer seizes the commodity.
After seizing the commodity, there is a proper manner of disposal of goods seized under the act, which is provided as per the Legal Metrology packaging rules. The manner of such disposal of food seized is given below:
- Any good seized under subsection 1 of section 29 of the act is subject to speedy and natural decay.
- The director or any other authorized officer on his behalf shall have the weights and measures on a verified weighing and measuring instrument available to him.
- The legal metrology officer may proceed to the place of seizure and enter the actual weight or measures of goods in the form of specified manner by the director for the purpose and shall obtain the signature of the trader, manufacturer or his agent or such other person who has committed the offense.
- The goods in question, after the weighing and measuring, shall be returned to the trader or the purchaser, as the case may be.
- Every trader, or his agent or other person who has committed the offense, refuses to sign the form. In such a situation, the director or a person who is authorized by the director on this behalf shall obtain the signature of not less than 2 of the witnesses present at the time of such diversity by the trader or his agent or any other person.
- If an offense under subsection 1 of the act is contained in a package and the package is false or does not confirm the provision of the act or the rule, the package is subject to speedy and natural decay. In such a situation, the director or any other person authorized by the director may dispose of the goods following the provisions of sub-rule 1.
- The director or the authorized person may on his behalf retain the package for prosecution under the act after taking the signature of the manufacturer, dealer, importer, packer of the commodity, or any other person on his behalf who has committed the offense and notice of such seizure.
Unverified Weight and Measures to be Verified and the Stamp
- Unverified weights or measures shall not be forfeited if seized under section 29 of the act. If the person from whom such weight or measure was seized agrees to get the same verified and stamped within a period of 10 days or such extended period from the date of such seizure and for this purpose.
- The person seizing such weights or measures shall afford a reasonable opportunity by returning such weights or measures exclusively for the purpose of verification and stamping.
Use of Regional Language
Any legend or denomination is specified under the rules, which is required to be indicated on any weights or measures in English or Devanagiri script. It may also be indicated in addition to English or Devanagiri on such weights or measures in such a religious language as the manufacturer may consider it practicable.
